🏛️ Introduction

The 1948 disturbances convinced the British colonial authorities that the political system of the Gold Coast needed significant reform. The Watson Commission had identified serious dissatisfaction, but another body was needed to work out specific proposals for a new constitution.

This led to the establishment of the Coussey Committee in 1949, chaired by Justice Sir Henley Coussey. Its recommendations became the basis of the Gold Coast (Constitution) Order in Council, 1950, which came into force on 1 January 1951. For this reason, it is also commonly called the 1951 Constitution.

🎯 What You’ll Learn

By the end of this lesson, you should be able to:

  • Explain why the Coussey Committee was formed.
  • Identify important recommendations of the Committee.
  • Describe the main constitutional reforms introduced.
  • Explain how the reforms moved the Gold Coast closer to self-government.

🔍 Background to the Coussey Committee

The political changes that followed the 1948 Accra Riots did not end with the Watson Commission.

The Watson Commission’s investigations helped show that the existing political arrangements were inadequate and that the Gold Coast needed greater African participation in government.

The next important question became:

What should the new political system look like?

A committee was therefore needed to develop more detailed constitutional proposals.

👥 Formation of the Coussey Committee

The Coussey Committee was established in 1949 and chaired by Justice Sir Henley Coussey.

Its main task was to consider constitutional reform and make recommendations for a new system of government that would give the people of the Gold Coast greater participation in governing themselves.

The Committee included representatives from different sections of Gold Coast society.

This was important because constitutional change was becoming a major national political issue.

⚖️ Why Was the Committee Necessary?

The Coussey Committee was formed partly because:

  • Political awareness had increased.
  • Nationalists were demanding greater African representation.
  • The 1948 disturbances had exposed dissatisfaction with colonial government.
  • The existing constitutional arrangements were considered inadequate.
  • Pressure for self-government was increasing.

The Committee therefore represented another step away from a system dominated by colonial officials towards one with greater African political participation.

📋 Recommendations of the Coussey Committee

The Coussey Committee recommended important changes to the political structure of the Gold Coast.

At JHS 1 level, the major ideas to understand include the following.

1. Greater African Representation

The Committee supported increasing the number of Africans participating in the government of the Gold Coast.

This meant that Africans would have a stronger voice in making decisions affecting their country.

2. A New Legislative Assembly

The existing Legislative Council was to be replaced by a broader Legislative Assembly.

The new arrangement provided for an Assembly composed overwhelmingly of Africans, representing a significant shift in political participation. Ghana’s Judicial Service describes the resulting Legislative Assembly as consisting almost entirely of elected Africans.

3. Greater Participation in the Executive

The reforms also increased African involvement in the executive side of government.

This was important because political participation should not involve only discussing and passing laws.

Africans increasingly needed experience in the actual administration of government.

4. Development of Local Government

The constitutional reform process also encouraged greater participation in government at the local level.

Local government could give people experience in:

  • Decision-making
  • Administration
  • Representation
  • Managing community affairs

This helped broaden political participation beyond the central government.

📜 The 1950 Constitution

There is an important date distinction to remember.

The legal instrument was the:

Gold Coast (Constitution) Order in Council, 1950

but it:

came into force on 1 January 1951.

That is why textbooks and historical discussions may refer to either the 1950 Constitution or, more commonly, the 1951 Constitution.

For your course, we can retain “1950 Constitution” in the lesson title while teaching learners this distinction clearly.

🏛️ Major Constitutional Reforms

The new Constitution brought significant changes to the government of the Gold Coast.

🗳️ 1. A Legislative Assembly

The former Legislative Council gave way to a Legislative Assembly.

This expanded African participation in law-making and national politics.

👥 2. Increased African Representation

Africans gained a much larger role in the political system.

This meant that colonial officials had less exclusive control over political decision-making than under earlier constitutional arrangements.

🏢 3. Reorganisation of the Executive Council

The Executive Council was reorganised under the new constitutional arrangements.

This helped create opportunities for Africans to gain greater experience in the administration of government.

🗳️ The 1951 Elections

The new constitutional arrangements created the framework for important elections in 1951.

The Convention People’s Party (CPP) achieved a major victory.

Kwame Nkrumah was still imprisoned when the elections took place, but he won his seat and was subsequently released.

This connected constitutional reform with a major change in political leadership.

🔄 From Constitutional Reform to African Government

⬇️

Greater African participation in government

This was a major advance towards self-government.

🇬🇭 Movement Towards Self-Government

The Constitution did not give the Gold Coast complete independence.

Britain still retained important powers.

However, it was significant because it moved the colony further towards Africans governing their own affairs.

The reforms provided:

  • Greater political participation.
  • More elected African representatives.
  • Experience in government.
  • Opportunities for nationalist parties to gain political power.
  • A stronger foundation for further constitutional reforms.

🌱 Learning Through Government

Political independence requires people who understand how to:

  • Make laws.
  • Run ministries.
  • Manage public institutions.
  • Debate national policies.
  • Represent citizens.
  • Make government decisions.

Greater African participation provided practical experience in these areas.

The constitutional reforms therefore helped prepare Gold Coast political leaders for greater responsibility.

⚠️ The Constitution Had Limitations

Although the reforms were an important advance, they did not provide full self-government.

The Governor still retained substantial powers, meaning that ultimate colonial authority had not disappeared.

This explains why nationalist demands continued even after the Constitution came into force.

The Constitution was therefore:

An important step towards self-government — not the final destination.

Further constitutional reforms were still necessary. Later amendments and reforms continued to transfer greater authority to African political leaders; by 1954, a new constitution provided virtually full internal self-government.

🔍 Coussey Committee vs Watson Commission

Learners should not confuse these two bodies.

Watson Commission Coussey Committee
Followed the 1948 disturbances Established after the Watson process
Investigated the causes of the disturbances Developed proposals for constitutional reform
Identified political and social dissatisfaction Proposed changes to the political structure
Helped show that reform was needed Helped determine what the reforms should look like

An easy way to remember:

Watson investigated the problem. Coussey helped design the constitutional response.

🧠 Think About It

Suppose a learner says:

“The Coussey Committee gave the Gold Coast independence.”

Is this correct?

No.

The Committee helped recommend constitutional reforms that increased African political participation.

However, colonial rule continued.

Its importance lies in helping the Gold Coast move closer to self-government, not in immediately achieving independence.

🌟 Importance to the Independence Struggle

The Coussey Committee and the Constitution that followed were important because they:

Increased African Political Participation

More Africans became directly involved in governing the country.

Created Opportunities for Elections

Political parties could test their support through electoral competition.

Developed Political Experience

African leaders gained experience in administration and government.

Strengthened the Movement Towards Self-Government

Political progress made demands for even greater control more difficult to reverse.

Prepared the Way for Further Reform

The constitutional process continued through the 1950s until independence was achieved in 1957.

🛤️ Constitutional Progress Was Gradual

The Gold Coast’s journey towards independence involved several stages:

⬇️

Coussey Committee

⬇️

1950 Order / 1951 Constitution

⬇️

📝 Lesson Summary

The Coussey Committee was established in 1949 under the chairmanship of Justice Sir Henley Coussey. It followed the Watson Commission and was tasked with developing proposals for constitutional reform in the Gold Coast.

Its recommendations contributed to the Gold Coast (Constitution) Order in Council, 1950, which came into force on 1 January 1951 and is therefore often called the 1951 Constitution.

The reforms expanded African representation, introduced a new Legislative Assembly and reorganised the machinery of government. They did not provide full independence, but they created greater opportunities for Africans to participate in government and helped move the Gold Coast closer to self-government.

The Coussey reforms therefore formed an important bridge between the political unrest of 1948 and the greater African political control that developed during the 1950s.
